DO NOT TALK TO THE POLICE; THEY ARE NOT YOUR FRIENDS
There are three general defenses to a criminal charge:
- You didn’t do it.
- They can’t prove it.
- The cops acted illegally and the evidence will be thrown out.
Don’t plea bargain unless you have to. There is no reason to make it easy for the government to put you in jail. These are some of the general principals under which I practice.
Do not plead guilty to “get it over with”. Do not plead guilty because it “stresses you out”, do not plead guilty because it will be difficult for you to come back for the trial. Criminal convictions do not go away. They are out there just waiting for someone to find them. Yes it takes money to fight a criminal charge, but it would be interesting to know how much less one will earn in a life time with a criminal conviction; criminal convictions follow you, they do not go away.
There are attorneys everywhere. Very few do criminal defense. You do not want someone who spends most of his time doing probated or a real estate attorney handling your criminal case. First, that attorney will not be familiar with the county attorney prosecuting you or the judge who will hear your case. Both are necessary for effective representation.
